Terms and Conditions 2018

General

All our offers and agreements relating to our transport activities/services are exclusively subject to:

  • National road transport: General Transport Conditions 2002 (AVC), filed with the District Courts of Amsterdam and Rotterdam.

  • International road transport: Convention on the Contract for the International Carriage of Goods by Road (CMR), with the AVC conditions applying additionally.

  • Storage services: Dutch Storage Conditions, filed on 15 November 1995 with the District Court of Rotterdam.

  • Freight forwarding services: Dutch Forwarding Conditions, filed on 1 July 2004 with the District Courts of Amsterdam, Arnhem, Breda, and Rotterdam, excluding Article 13.

  • Warehousing: Physical Distribution Conditions (latest version), as established by Stichting Vervoeradres and filed with the District Courts of Amsterdam and Rotterdam.

  • Vertical transport: General Conditions of the Association for Vertical Transport – January 2010 version (VVT).

  • Exceptional transport: General Conditions for Exceptional Transport (AVET).

  • Stevedoring services: General Conditions of the Association of Rotterdam Stevedores, filed with the District Court of Rotterdam on 12 August 1976.

  • Logistics Services Conditions (LSV): filed by FENEX (the Dutch Organisation for Forwarding and Logistics) and TLN (Transport and Logistics Netherlands) with the District Court of Rotterdam on 2 April 2014 under number 28/2014.

  • In addition to the above conditions, the Transport and Logistics Netherlands General Payment Conditions apply, filed with the District Court of The Hague on 2 July 2002.

Unless otherwise agreed, the latest version of the applicable conditions referred to above shall apply. These conditions will be sent to you free of charge upon request. Unless expressly agreed otherwise in writing, the general terms and conditions of Peters Transport shall prevail over those of the contracting party and form an integral part of all concluded and future agreements and services performed.


Rates

  • Rates are valid for one year from 01-01-2018 and are exclusive of VAT, MAUT, and diesel surcharge.

  • Any costs for booking programs such as Transporeon are at the client’s expense.

  • Rates apply throughout the Benelux, excluding the Wadden Islands (unless stated otherwise).

  • Rates exclude additional costs for city center deliveries, island deliveries, and environmental zone charges.

  • Unless agreed otherwise, each agreement concerns transport in accordance with our services and related transit times. Deviations may result in higher costs.

  • Rates are always per shipment. A shipment consists of one loading address and one unloading address.

  • Agreed transit times are based on normal five-day working weeks, without weekday or weekend driving restrictions.

  • National public holidays during the week may affect transit times and costs (including return loading options and 200% collective labor agreement payment). This applies to both national and international public holidays. Work performed on national public holidays is charged at 200% in accordance with our collective labor agreement.

  • We reserve the right to pass on cost increases beyond our control, such as government measures (e.g., road pricing).

  • Wage clause: rates are based on current wage levels. For every 1% wage increase, rates will be adjusted by 0.45%.

  • Prices are stated in euros.

  • All rates issued by Peters Transport are subject to typographical and printing errors.


Timed Deliveries (loading and unloading)

  • Fixed time delivery: €80.00 surcharge

  • Before 10:00: €60.00 surcharge

  • Before 12:00: €45.00 surcharge


Toll / MAUT

Toll and MAUT charges are not included in the rates and will be charged based on the applicable toll rates at the time.


Payment Terms

  • The Transport and Logistics Netherlands General Payment Conditions apply to all our services.

  • Payment term: 30 days from invoice date.

  • Late payment may result in interest and collection charges.

  • All services are subject to sufficient credit coverage by our credit insurer.

  • All legal relationships are governed by Dutch law.


Maximum Weight

  • National transport: maximum payload 30,000 kg (vehicle including load max. 50,000 kg). Higher payloads possible upon request with specialized equipment.

  • International transport: maximum payload 25,000 kg (vehicle including load max. 40,000 kg, except Belgium where 44,000 kg is permitted).

  • Heavier equipment (e.g., vehicles equipped with a crane or truck-mounted forklift) is subject to different maximum payloads; please contact customer service.

  • Vehicles must be loaded to prevent axle overload and ensure proper weight distribution. The driver’s instructions are leading.

  • Out-of-gauge shipments only in consultation with customer service/planning.


Conversion Factors

Rates are determined based on the following conversion factors. The highest outcome determines the rate:

  • Max. 1,850 kg = 1 loading meter

  • 1 m³ = max. 330 kg = 0.2 loading meter

  • 1 euro pallet (120×80 cm) = max. 750 kg = 0.4 loading meter

  • 1 block pallet (120×100 cm) = max. 925 kg = 0.5 loading meter

If rates are based on kilograms, the maximum of the previous scale unit applies as the minimum of the calculated unit.

For non-standard dimensions, loading meters are calculated as (length × width) / 2.4. Loss of loading space is entirely at the client’s expense. If goods exceed pallet dimensions, calculations are based on the dimensions of the goods.


Acceptance of Transport Orders / Accessibility

  • A transport order is only accepted after receipt of written or electronic confirmation.

  • Goods must be properly packaged. The client remains liable for damage caused by inadequate packaging.

  • Each transport unit must be marked with at least: sender details, full destination details (name, address, country, postal code, city), and reference number.

  • All loading and unloading addresses must be accessible for a truck with dimensions (l x w x h): 18.75 x 2.60 x 4.00 meters.


Collection of Shipments

Goods will be collected the next working day if:

  • Shipping details are submitted before 14:30 one working day prior to collection (via fax/email).

  • Shipping details are complete, including:

    • recipient name, address, postal code, city, country

    • unloading by truck-mounted forklift (moffett) or crane

    • number of items, unit type, and total weight

    • goods accompanied by a consignment note issued by the client

  • Urgent shipments in consultation with planning.


Cancellation

An order may be cancelled free of charge provided that:

  • no costs have been incurred by us;

  • cancellation is communicated well in advance (not on the scheduled loading day).

If planning has already been completed or physical activities started, actual costs will be charged, up to a maximum of 80% of the order value.


Delivery

  • Deliveries take place between 07:00 and 17:00. Other times in consultation with planning. Timed deliveries are subject to surcharges as stated in the quotation.

  • For loads wider than 3.00 meters, a permit may be required. Additional costs (permit + escort) will be charged.


Exceeding Loading and Unloading Times

  • Full loads: loading/unloading exceeding 1 hour will be charged at €64.00 per hour.

  • Part loads: 15 minutes for the first pallet/loading meter, then 5 minutes per pallet/loading meter, with a maximum of 1 hour for a full load. Excess time charged at €64.00 per hour.

  • Waiting time: €64.00 per hour.


Pallet Exchange

Exclusive of pallet exchange unless agreed otherwise. Rates and conditions available upon request.


Miscellaneous

Peters Transport reserves the right to subcontract (part of) the services to independent subcontractors.


Insurance

  • Goods are insured during international transport under CMR conditions (maximum carrier liability SDR 8.33 per kg) and during national transport under AVC conditions (maximum carrier liability €3.40 per kg). Consequential damages are excluded. If the value of your goods exceeds these limits, you must arrange additional transport insurance yourself.

  • Any transport damage must be noted on the CMR/AVC delivery receipt upon receipt and reported in writing to Peters Transport within 24 hours. Consequential damages are excluded at all times.

  • The client is never entitled to offset any amounts against freight charges owed.
